Our starting point is that all companies - as "corporate citizens" - owe responsibilities to society. This means acting responsibly and ethically towards employees, local communities, contractors, the environment and in dealings with governments.

The law supports CSR in a multitude of ways. For instance, by providing incentives for good behaviour, and a system of sanctions against the bad. It can provide frameworks through which companies can reach out to stakeholders, build partnerships, protect their rights and enhance relationships. It can provide routes through which information can be obtained, and commitments enforced. And it can provide a means by which people can seek compensation when things go wrong.

But the law - as it relates to CSR - is also complex, multi-disciplinary, multi-jurisdictional, and constantly changing. And the pace of change is set to quicken, as litigation against companies gathers pace and governments continue to grapple with the consequences of the global economic crisis . While self-regulation and voluntary initiatives will remain important, there is now a renewed appetite among legislators for greater regulatory intervention to encourage (and if necessary compel) companies to "do the right thing".
